1. Introduction

Welcome to AssetMX. These Terms of Service (“Terms”) govern your use of the AssetMX website and services operated by Blackrock Leasing Pty Ltd (trading as AssetMX) ABN 15 681 267 818, Australian Credit Licence 569484 (“we”, “us”, “our”).

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Our Services

AssetMX provides an online platform for Australian businesses to obtain quotes and apply for asset finance. Our services include:

• Online finance calculators and quote tools
• Application submission and processing
• Connection to lending partners
• Document collection and verification

We hold our own Australian Credit Licence. Our only fee is the $800 platform fee, disclosed in our Credit Guide. We do not receive commissions from lenders.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be an Australian resident or citizen
• Have a valid Australian Business Number (ABN)
• Have the authority to act on behalf of the business applying for finance

4. Your Obligations

When using our services, you agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us immediately of any unauthorised access
• Not use our services for any unlawful purpose
• Not misrepresent your identity or business details

Providing false or misleading information may result in termination of services and may constitute fraud.

5. Quotes and Applications

Quotes provided through our calculator are indicative only and subject to credit assessment. Final rates, terms, and approval are determined by the lending partner based on their assessment criteria.

Submitting an application does not guarantee approval. We reserve the right to decline applications or refer them for additional review at our discretion.

6. Fees and Charges

Our platform fee is $800 (inclusive of GST), payable at settlement. This fee is:

• Shown separately from lender interest rates
• Only charged if your finance application settles
• Non-refundable once settlement occurs

Additional fees may be charged by lending partners. These are disclosed before you accept a finance offer.

7. Privacy and Data

We collect and handle your personal information in accordance with our Privacy Policy. By using our services, you consent to this collection and handling.

We may share your information with lending partners, credit reporting bodies, and service providers as necessary to process your application.

8. Intellectual Property

All content on the AssetMX website, including text, graphics, logos, and software, is owned by us or our licensors. You may not reproduce, modify, or distribute this content without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of our services.

Our total liability to you for any claim arising from these Terms or our services is limited to the fees you have paid us in the 12 months preceding the claim.

10. Dispute Resolution

If you have a complaint about our services, please contact us at [email protected]. We will endeavour to resolve your complaint within 30 days.

If we cannot resolve your complaint, you may refer it to the Australian Financial Complaints Authority (AFCA). AFCA provides fair and independent financial services complaint resolution that is free to consumers.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date. Your continued use of our services after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
